FIRVISTA GAME STUDIO (hereinafter referred to as “the Circle”) has established the following privacy policy (hereinafter referred to as “the Policy”) with regard to the personal data of users. This Policy sets out how FIRVISTA GAME STUDIO This Policy explains what personal information we collect, how we use and share it, and how members and users can manage their own personal information.

Article 1 (Security of personal information)
The CIRCLE will take appropriate measures to protect personal information, and will take necessary and appropriate measures to prevent leakage, loss or damage of personal information handled by the CIRCLE, and to otherwise manage personal information safely.

Article 2 (Scope of personal information)

  1. ‘Personal information’ of a Member means information relating to the identification of the User, e-mail address and other information generated or accumulated in relation to the Member and collected by the CIRCLE.
  2. ‘Personal information’ of a user refers to information that identifies an individual and that can be used to identify a specific individual by name, date of birth, address, telephone number and other descriptions.

Article 3 (Collection of personal information and its methods)

    The following types of personal information may be collected by our Circle: – Names, email addresses, DiscordIDs and related information on the application form and questionnaire submitted when participating in our Circle.
    Information on computers, devices and software based on the use of our works.

    Information on the player, member or other customer’s enquiries.

  2. our circle may ask for information that can identify individuals such as name, address, date of birth, telephone number, email address, credit card number, driver’s licence number, etc. by filling in the application form and questionnaire that we ask you to submit when you join our circle or when you register to use our circle. We may also collect transaction records and payment information, including the personal information of the User, from our partners.

Article 4 (Purpose of collecting personal information)
The purposes for which we collect information about our members are as follows: – To collect information required for member management.

To check what kind of technology members possess and what kind of actions they are capable of performing.

To provide and improve our game services.
To conduct research and analysis for the purpose of improving our services, including the development of better games.
To provide and improve the game services provided by the Circle.
Prevention of infringement of copyright and other rights.
Other purposes as required by the CIRCLE.

Article 5 (Change of purpose of use)
The CIRCLE shall only change the purpose of use of personal information if the purpose of use is reasonably deemed to be related to the purpose of use before the change.
When the purpose of use is changed, the Circle shall notify the User or Player in the manner prescribed by the Circle, or make a public announcement on the Website.

Article 6 (Provision of personal information to third parties)

  1. except in the following cases, the CIRCLE will not provide personal information to third parties without the prior consent of Members and Users. However, this excludes cases permitted under the Personal Information Protection Act and other laws and regulations. 1.
     1. when games or video works developed by the circle are made public.
     2. when it is necessary for a state organ, a local authority or a person entrusted by them to carry out affairs prescribed by law, and when obtaining the consent of the person concerned may hinder the carrying out of those affairs.

  2. notwithstanding the provisions of the preceding paragraph, in the following cases, the party to whom the information is provided shall not fall under the category of a third party
     1. when the person is a management member of the Circle and has been designated as a management member in the rules in advance, and has been informed of this for more than six months and has notified the person in advance.
  3. when the Circle outsources all or part of the handling of personal information within the scope necessary for the achievement of the purpose of use
  4. when personal information is provided as a result of a merger or when the Circle succeeds to part or all of the business for other reasons
  5. when the information becomes public knowledge for reasons attributable to the user or player
  6. when the Circle notifies the person in advance of the name, affiliation, etc. of the person with whom the information will be shared within the scope necessary to achieve the purpose of use, or when the person is in a situation where he or she is aware of such information.

Article 7 (Disclosure of personal information)
When the CIRCLE is requested to disclose personal information by the person concerned, the CIRCLE will notify the person without delay. However, if for any reason it is difficult to disclose part or all of the personal data, the CIRCLE will promptly notify the person to that effect.
If the CIRCLE responds to a request for disclosure of personal information, it will charge a fee of 1,000 yen.

Article 8 (Correction and deletion of personal information)
Members and Users may request the Circle to correct, add or delete (hereinafter referred to as “correction”) their personal information in the manner specified by the Circle, if their personal information held by the Circle is incorrect. 2.
If CIRCLE receives a request from a Member or User as described in the preceding paragraph and deems it necessary to respond to the request, CIRCLE will correct or delete the information without delay. 3.
If the CIRCLE makes a correction in accordance with the preceding paragraph or decides not to make a correction, the CIRCLE will notify the Member or User of this without delay. 4.
In the following cases, as a rule, corrections will not be made
 1. when it is deemed that there is a risk of affecting the operation of the Circle.

Article 9 (Deletion or suspension of personal data)
Personal data submitted to the CIRCLE will be deleted or suspended in the following cases

  1. when a member of the Circle withdraws from the Circle based on his/her own will and requests deletion
  2. when the user has deleted his/her own registration information
  3. when it is deemed appropriate to delete the information in accordance with laws and regulations; 4. when the deletion is not in accordance with the previous regulations
  4. when it is necessary for a state organ, a local public body or a person entrusted by such a body to carry out affairs prescribed by law, and when obtaining the consent of the person may hinder the carrying out of such affairs.
  5. when the person concerned requests the suspension or deletion of the information on the grounds that it has been used for a purpose that deviates from or exceeds the purpose of use, or that it has been obtained by unlawful means.
  6. when we consider it necessary to respond to the request in accordance with the preceding paragraph, we will investigate without delay and stop using the information without delay; 3. when we stop using or delete the information in question in accordance with the preceding paragraph, or decide not to do so, we will notify you to that effect without delay; or 4. when we have decided to stop using or delete the information in question in accordance with the preceding paragraph, or have decided not to do so, we will notify you to that effect without delay. The Circle will notify you to that effect without delay.

Article 10 (Changes to privacy policy)
The content of this policy can be changed without notice to the user or members in principle, unless otherwise stipulated by law, this policy or special provisions. 2.
Unless otherwise stipulated by the CIRCLE, the changed Privacy Policy shall take effect from the time it is posted.

Article 12 (relating to translation of privacy policy).
In the event of any differences between the English and Japanese versions of this Privacy Policy, the Japanese version of the Privacy Policy shall prevail.

Article 13 (Agreed jurisdictional court)
All disputes arising on this website between the CIRCLE and users shall be subject to mutual and sincere negotiation. However, if the dispute cannot be settled by these means, the Saitama Summary Court or the Saitama District Court shall be the court of exclusive jurisdiction of the first instance (including court mediation procedures).
